End User License Agreement (EULA)

This End User License Agreement ("Agreement") is a binding legal agreement between you ("User" or "You") and Zekican YILMAZ ("Developer," "We," or "Us") regarding your use of the Nottely mobile application (the "App").

1. Acknowledgment

You and the Developer acknowledge that this Agreement is concluded between you and the Developer only, and not with Apple Inc. ("Apple"). The Developer, not Apple, is solely responsible for the App and the content thereof.

2. License Grant

The Developer grants you a limited, non-exclusive, non-transferable, revocable license to use the App on any Apple-branded products that you own or control, as permitted by the Usage Rules set forth in the Apple Media Services Terms and Conditions.

3. Scope of Service and AI Disclaimer (Critical)

The App uses third-party Artificial Intelligence (AI) services (including AssemblyAI and OpenAI) to process audio and text.

• Prohibited Use: You agree NOT to rely on the App for critical situations, including but not limited to: medical emergencies, legal proceedings, 911 calls, or high-stakes financial decisions.
• Audio Recording Laws: You are solely responsible for complying with all applicable laws regarding the recording of conversations (e.g., "Two-Party Consent" laws). You must obtain necessary consents before recording.

4. Subscriptions and Payment

The App offers "Premium" auto-renewing subscriptions managed via Apple's In-App Purchase system (RevenueCat).

• Payment: Charged to your Apple ID Account at confirmation of purchase.
• Auto-Renewal: Subscription automatically renews unless auto-renew is turned off at least 24-hours before the end of the current period.
• Account Charged: Account will be charged for renewal within 24-hours prior to the end of the current period.
• Cancellation: You can manage and cancel subscriptions in your Account Settings on the App Store after purchase.
• No Refunds: As a standard Apple policy, all sales are final. We cannot issue refunds directly; requests must be made to Apple.

5. Maintenance and Support

The Developer is solely responsible for providing any maintenance and support services for the App. You and the Developer acknowledge that Apple has no obligation whatsoever to furnish any maintenance and support services with respect to the App.

6. Warranty and Liability

• In the event of any failure of the App to conform to any applicable warranty, you may notify Apple, and Apple will refund the purchase price for the App to you. To the maximum extent permitted by applicable law, Apple will have no other warranty obligation whatsoever with respect to the App.
• LIMITATION OF LIABILITY: IN NO EVENT SHALL THE DEVELOPER BE LIABLE FOR ANY INDIRECT, SPECIAL, OR CONSEQUENTIAL DAMAGES (INCLUDING LOSS OF DATA, BUSINESS, OR PROFITS) ARISING OUT OF THE USE OF OR INABILITY TO USE THE APP.

7. Intellectual Property Rights

You acknowledge that, in the event of any third-party claim that the App or your possession/use of the App infringes that third party's intellectual property rights, the Developer, not Apple, will be solely responsible for the investigation, defense, settlement, and discharge of any such intellectual property infringement claim.

8. Legal Compliance

You represent and warrant that (i) you are not located in a country that is subject to a U.S. Government embargo, or that has been designated by the U.S. Government as a "terrorist supporting" country; and (ii) you are not listed on any U.S. Government list of prohibited or restricted parties.

9. Third Party Beneficiary

You and the Developer acknowledge and agree that Apple, and Apple's subsidiaries, are third-party beneficiaries of this Agreement. Upon your acceptance of this Agreement, Apple will have the right (and will be deemed to have accepted the right) to enforce this Agreement against you as a third-party beneficiary thereof.

10. Governing Law

This Agreement is governed by the laws of the Republic of Türkiye. Any disputes shall be resolved in the courts of Ankara.
